Terms of Service

The rules and conditions for using GBP Local Ranker, including accounts, billing, Google integration, and acceptable use.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GBP Local Ranker ("Company," "we," "us") governing your access to and use of the GBP Local Ranker platform, website, Chrome extension, and related services (collectively, the "Service").

Creating an account or connecting Google is your request that we process the account data described in the Privacy notice for the purpose of providing the Service. Analytics cookies and optional messages need a separate consent. The Privacy notice at /privacy and the data-rights page at /data-rights are part of these Terms.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you use the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

The Service is designed for local businesses and marketing agencies managing Google Business Profiles. You must comply with all applicable local, state, national, and international laws.

3. Account Registration & Security

You must provide accurate, current, and complete registration information and keep it updated.
You are responsible for safeguarding your password and all activity under your account.
Notify us immediately at support@gbplocalranker.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts with false, misleading, or incomplete information.
One person or legal entity may not maintain more than one free trial account.

4. Description of Service

GBP Local Ranker provides tools for Google Business Profile management including review monitoring and responses, QR code generation, local SEO audits, map grid rank tracking, AI-powered content optimization, landing page building, and optional Netlify website publishing.

Features vary by subscription plan. We may add, modify, or discontinue features with reasonable notice. Beta features are provided "as is" and may change without notice.

5. Google Integration & API Usage

Certain features require connecting a Google account and authorizing access to Google Business Profile APIs. You represent that you have the right to manage the Google Business Profile locations you connect.

You agree to comply with Google's Terms of Service, API Services User Data Policy, and Google Business Profile guidelines. We are not responsible for Google policy changes, API outages, or account suspensions by Google.

You may not use the Service to violate Google's policies, generate fake reviews, manipulate rankings through prohibited means, or scrape Google data beyond authorized API scopes.

6. Acceptable Use Policy

You agree NOT to:

Use the Service for any unlawful purpose or to solicit unlawful activity.
Post, transmit, or store content that is defamatory, obscene, harassing, or infringes third-party rights.
Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
Reverse engineer, decompile, or attempt to extract source code except as permitted by law.
Use automated scripts to abuse the Service, exceed rate limits, or circumvent plan restrictions.
Resell or sublicense the Service without written permission from GBP Local Ranker.
Remove or alter proprietary notices, branding, or attribution where required by your plan.
Use review automation to solicit fake, incentivized, or misleading reviews in violation of platform policies.

7. Billing, Subscriptions & Refunds

Paid plans are billed in advance on a monthly or annual basis. Prices are listed on our Pricing page and may change with 30 days notice to existing subscribers.

Subscriptions auto-renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period; no partial refunds for unused time except as stated in our Refund Policy.

Failed payments may result in service suspension. You remain responsible for all charges incurred before cancellation.

Refunds are governed by our Refund Policy at /refund.

8. Intellectual Property

The Service, including software, design, logos, documentation, and AI models, is owned by GBP Local Ranker and protected by copyright, trademark, and other intellectual property laws.

Agency plan subscribers may use branded PDF reports for their clients during an active subscription. This license terminates upon cancellation.

9. User Content & Data

You retain ownership of content you upload or create (landing pages, QR designs, audit notes). You grant us a worldwide, non-exclusive license to host, display, and process your content solely to provide the Service.

You are solely responsible for ensuring your content complies with applicable laws and third-party rights. We may remove content that violates these Terms or receive valid DMCA takedown notices.

10. Personal data (DPDP Act)

GBP Local Ranker is the Data Fiduciary for personal data processed through the Service. Processing follows the Digital Personal Data Protection Act, 2023 and our Privacy notice.

You must be 18 or older. Do not submit personal data of a child. You confirm that personal data you upload about your customers or staff is processed by you as Data Fiduciary for your own purpose, and that you have given those people the notice and obtained any consent the Act requires before you ask us to process it as your Data Processor.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee specific Google ranking results, review volumes, or revenue outcomes. Local SEO depends on many factors outside our control including Google algorithm changes and competitor activity.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, infringement of third-party rights, or content you submit.

14. Termination

You may cancel your account at any time via Settings or by contacting support. We may suspend or terminate your access immediately for violation of these Terms, non-payment, or conduct harmful to the Service or other users.

Upon termination, your right to use the Service ceases. We may delete your data after a reasonable retention period except where required by law. Sections that by nature should survive (liability, indemnity, governing law) will survive termination.

15. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute shall be resolved in the courts located in Ghaziabad, Uttar Pradesh, India.
